DUI, Criminal, Traffic, and Fair Treatment for Consumers

DUI- I have nearly 20 years experience with DUI law.  Each case is carefully reviewed, and I will thoroughly defend your rights at every stage of the process, and challenge the evidence against you wherever possible.  What are common challenges to DUI:

Whether this is your 1st, 2nd or 3rd offense, DUI laws and penalties are tough, and refusing to submit to a breath test results in  at least a one year driver's license suspension in both Kansas and Missouri.   After your arrest there is only ten days to challenge this in Kansas, and fifteen in Missouri.  And in Kansas even if you take a test, if your breath/blood alcohol level is over .15, you will loses you license for a year even if your first offense.  In addition, for criminal purposes, Kansas used to consider only those DUI's occurring in the previous five years for sentencing purposes.  Now, convictions any time within your lifetime enhance your current charge.  And Missouri considers all DUI's in the past 10 years in imposing sentences.  It is vital to have an experienced, competent attorney to represent on these types of charges.

  • Fair Debt Collection Violations-Contrary to what you may have experienced, debt collection efforts are strictly regulated by state and federal laws.  Fair debt collections laws set forth  permissible and impermissible methods for collectors when pursuing debts, for example, the collector may not harass you, contact you at inconvenient times or places, or after being told to stop.  Although violations of these laws do not 'wipe away' legitimate debts, such violations may result in compensation to you for the damages suffered, and court costs.
  • Fair Credit Reporting Violations-Federal and state fair credit reporting statutes promote the accuracy and privacy of information kept and distributed by the nation's consumer reporting companies by defining how information must be recorded, verified and safeguarded.  These requirements are critical as the accuracy of your credit report can affect whether you qualify for a loan and at what interest rate, and the privacy of your information guards against identity theft, a very serious problem that can ultimately affect your ability to get credit, insurance, or even a job.  Credit reporting violations include where your credit report contains information that is inaccurate or  incomplete, disputed, or outdated.  Violations of these statutes require compensation for the damages suffered, court costs, and more importantly, allow you to correct and protect your credit report in the future.
